Privacy Policy
Trust & Legacy Consulting Limited values your privacy, and will comply with the requirements set out in the Privacy Act 2020. Trust & Legacy Consulting Limited’s Privacy Policy is detailed below, which we encourage you to read in conjunction with our Letter of Engagement.
Collection of personal information
If you engage Trust & Legacy Consulting Limited to act for you, Trust & Legacy Consulting Limited will collect and store personal information about you which may include your name (or firm name), contact details, dates and locations of birth, country of residence, and information about trusts, companies or other entities associated with you (for example, trustee companies managed under your firm).
This information may be provided directly by you, or via Trust & Legacy Consulting Limited’s website, or in some cases from other sources, such as publicly available information on the Companies Office website or information provided by another person you have authorised to provide us with instructions.
You can choose not to provide personal information, but this may mean that Trust & Legacy Consulting Limited cannot act for you.
Holding and using your personal information
Trust & Legacy Consulting Limited collects personal information so that we can act for you and provide the services outlined in our Letter of Engagement.
Trust & Legacy Consulting Limited may also use your personal information to verify your identity (if required, for example to comply with AML/CFT requirements), and to provide you with updates and marketing services (which you can choose to opt out of at any time).
Trust & Legacy Consulting Limited may also use non-identifiable personal data (which cannot identify you) to better understand how clients and prospective clients use Trust & Legacy Consulting Limited’s website, and to improve the website and Trust & Legacy Consulting Limited’s offered services.
By entering any personal information into Trust & Legacy Consulting Limited’s website, or engaging Trust & Legacy Consulting Limited to act for you, you consent to your personal information being collected, held and used in this way and for any other use you authorise.
Protecting your personal information
Trust & Legacy Consulting Limited will take all reasonable steps to protect your personal information from unauthorised access, use or disclosure. This includes information security and cyber considerations such as password protection and two-factor authentication to access systems which store your personal information, anti-malware and patch management, and any hard copy information being held at the workplace of Trust & Legacy Consulting Limited in secure storage.
Trust & Legacy Consulting Limited will advise you as quickly as possible if there is a security breach where your personal information has been accessed or disclosed by any unauthorised person.
Trust & Legacy Consulting Limited will only disclose your personal information if it is necessary and appropriate to facilitate the reasons your personal information was provided (see ‘Holding and using your personal information’) or you ask Trust & Legacy Consulting Limited to disclose your personal information for another reason, unless disclosure is otherwise required by law.
Accuracy of and access to your personal information
It is your responsibility to ensure that the personal information you provide to Trust & Legacy Consulting Limited is correct and up-to-date. Please let us know if you are aware of changes to your personal information that we should be aware of, including changes to contact details.
You can ask to access the personal information that Trust & Legacy Consulting Limited holds about you at any time. You can also ask that Trust & Legacy Consulting Limited updates or corrects your personal information at any time, or corresponds with you in a different way - for example, if you no longer wish to receive email communication and would like everything sent via post.
Please note if your firm/business has instructed Trust & Legacy Consulting Limited, we can generally only provide personal information to those person/s who have authority to instruct Trust & Legacy Consulting Limited on the matter.
Trust & Legacy Consulting Limited will process such access or update/correction requests as soon as possible, unless Trust & Legacy Consulting Limited is prevented from doing so on legal grounds or if your personal information is not easily accessible. For example, it may be necessary for Trust & Legacy Consulting Limited to delay or deny your request if it would have an unreasonable impact on the privacy or affairs of others, or if it is not reasonable and practicable for Trust & Legacy Consulting Limited to process your request in the manner you have requested.
Trust & Legacy Consulting Limited may charge you the reasonable costs of providing you with your personal information, for example, if you request this information to be printed out and couriered to you.
Length of keeping your personal information
Trust & Legacy Consulting Limited will only keep your personal information for as long as your personal information is required for the purposes of collection, unless Trust & Legacy Consulting Limited is required to hold your Trust & Legacy Consulting Limited for a longer period (for example, under AML/CFT requirements or other applicable laws).
If you provide any personal information about your own clients during the engagement, such as client files or other documentation, these will be returned to you at the end of the engagement.
Complaints
If you wish to complain about how Trust & Legacy Consulting Limited has handled your personal information, please provide with full details of your complaint and any supporting documentation to the Director (sarah@trustandlegacy.nz). Sarah will endeavour to provide a response as quickly as possible and within 10 business days, and resolve the issue as quickly and pragmatically as possible.
Updates to this policy
Trust & Legacy Consulting Limited reserves the right to update this policy at any time. Any updated policy will be effective from the time it is published on Trust & Legacy Consulting Limited’s website. Your continued access of Trust & Legacy Consulting Limited’s website and engagement will be deemed to be your acceptance of any updated policy.
